In this Privacy Policy “Zurich”, “we”, “our” and “us” means Zurich Financial Services Australia Ltd and all the Zurich companies listed below in the section on ‘Which Companies are covered by this Policy’. This Privacy Policy also applies to “OnePath branded” products issued by Zurich companies.

We value the privacy of your personal information. We are committed to handling your personal information responsibly and in accordance with the Privacy Act 1988. By applying for, renewing, using any of our products or services, making a claim or providing us with your personal information you consent to your information being collected, held, used and disclosed as set out in this Privacy Policy.

This Privacy Policy should be read in conjunction with the Privacy Statement that was issued in respect to the type of relationship you have with us. To review a sample privacy statement, please refer to the ‘Zurich’s Privacy Statement’ section.

What is personal information?

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable:

  • Whether the information or opinion is true or not; and
  • Whether the information or opinion is recorded in a material form or not.

What type of information does Zurich collect and hold?

The type of personal information we hold about you or other individuals varies depending on the type of product or service we provide to you. For example, Zurich will hold different personal information about you or other individuals if you have a life insurance policy than we will hold if you have a managed investment or a general insurance product. We may also hold different information if we are providing you with financial advice as your financial adviser.

In general, Zurich may hold the following personal information:

  • Name and address
  • Date of birth
  • Contact details, which may include your telephone number, residential address and email address.

Depending on the type of product or service you select we may also hold the following information about you:

  • Occupation
  • Type of property that is being insured
  • Government issued identification numbers such as Tax file number, driving license or passport number, where you have given it to us
  • Payment card number or bank account details
  • Insurance claim information, where this is relevant
  • Your employment information
  • Your salary
  • The names and addresses of your dependents or beneficiaries
  • Information you give about your personal and financial circumstances
  • Other information that you have given us.

We may also collect sensitive information such as:

  • Health or medical information
  • Racial or ethnic origin
  • Sexual preferences or practices
  • Membership of political, professional or trade associations
  • Criminal convictions and driving offences.

If we are not able to collect your personal information, we may not be able to process your application, administer your policy, assess your claim or provide you with financial advice (where we are your financial adviser).

For employment applications Zurich may also hold the following information about you:

  • Employment history
  • Education qualifications and professional associations
  • Details of your referees
  • Details on your eligibility for employment such as residency status
  • Other information required as part of the recruitment process
  • Background checks, where you have given your consent to us.

How does Zurich collect and hold your personal information?

We collect your personal information so that we can perform our various functions and activities. We also collect your personal information if the law requires us to collect it. If we do not collect your personal information, we may not be able to deal with you, or provide you with a product or service. If you apply for one of our products or services, we may collect and hold information from you such as your name, address, telephone number, e-mail address, tax file number (TFN), date of birth and place of work.

We may collect personal information about you and other individuals in different ways including:

  • In writing, including by electronic or hard copy forms
  • By telephone
  • By email
  • In person
  • Over the internet such as via our website, cookies, online forms or social media.

We may collect your information:

  • Directly from you, for example, you provide us with your information when you fill in an application form, deal with us over the telephone, send us a letter or use our websites and customer portals;
  • From publicly available sources of information, such as telephone directories, the electoral roll or other websites; and/or
  • From other parties including:
    • Your intermediary, broker or professional adviser(s)
    • Other insurers, reinsurers or distribution partners
    • Our service providers and business partners
    • Organisations that we have an arrangement with to jointly offer products or services
    • Organisations that we have an alliance with to share information for marketing purposes to provide you with products or services and/or to promote a product or service;
    • Superannuation fund trustees holding Zurich or OnePath branded products, joint issuers of Zurich and OnePath branded products and other organisations including those in an alliance with us, to co-issue, distribute, improve, manage and administer our products and services, carry out business functions and undertake analytics activities;
    • Our related entities so we can better manage your relationship with us
    • Marketing companies if we acquire contact information to tell you about our products and services that may interest you
    • Third parties who, at the time of collection, have notified you that your information will be provided to us
    • Medical practitioners where relevant for the purposes of managing or administering our products including assessing your application or claim
    • Government, statutory or regulatory body and law enforcement bodies
    • Other third parties
    • Anyone that you have authorised to deal with us or that you have consented to them providing your information to us.

We may also collect information about how you use Zurich’s and other websites to help us better tailor our services to you. For example, we may do this when you click on a link from our website or visit a website which displays our advertisement. Usually, the information we collect in this way is general information only derived from cookies – such as the number of visitors to a site or statistics about how a site is browsed – and does not identify you. If we do identify you with this information (for example, if you have been logged onto one of our online services), any use or disclosure of that information will be in accordance with this Privacy Policy.

 If you provide personal information to us about another individual, you must:

  • Inform them that you are disclosing their personal information to us
  • Collect their consent to do so
  • Make them aware of the content of this Privacy Policy and
  • Direct them to this Zurich Privacy Policy

Sensitive information is personal information about a person’s racial or ethnic origin, political opinion, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual orientation or practices, criminal record, genetic information, health information, biometric information that is used for identification or biometric templates. We will not collect, use or disclose sensitive information about you unless we need the information for one of our functions or activities and we have your consent (or we are legally required to do so). For example, we will collect health information from you and your medical practitioner with your consent to assess your application for life insurance, to administer your policy and assess any claim made under your life or general insurance policy. We may also collect sensitive information about you if your family members apply for products such as life insurance or trauma and disablement cover. We may also collect sensitive information through customer surveys or questionnaires so that we may obtain your feedback and provide further information to you about our products or services. More information about our marketing practices can be found in the section titled “Marketing and Privacy” in this document.

Collecting information required by law

We may collect information from you because we are required or authorised by an Australian law or court or tribunal order. We will tell you if collection is required or authorised by law and provide you with details of the law, court or tribunal order. We are authorised by the Superannuation Industry Supervision Act 1993 to request that you provide your Australian tax file number (TFN). If we collect your TFN, we will handle your TFN in accordance with the Privacy Act and the TFN Rule issued by the Commissioner.

We may also be required to ask about your tax residency status under taxation information sharing agreements the Australian Government has in place with other countries. For example, a tax treaty between Australia and the United States means Australian taxation law has enacted the US Foreign Account Tax Compliance Act locally which requires us to ask account holders of some types of products whether they are US citizens or US tax residents when they open their product. If you are a tax resident of another country, the relevant treaty or law may require us to collect your relevant foreign tax identification number.

The Purposes for which Zurich Collects, Holds, Uses and Discloses this Information

Zurich provides products and services, such as:

  • General insurance
  • Life insurance
  • Investments
  • Superannuation
  • Financial advice

We collect, hold, use and disclose your personal information for the purposes of providing you with products and services and managing our business including after your policy ceases to be in-force or you have ceased to received services from us, such as:

  • To assess your application. For example, assessing the risk and underwriting your policy
  • To administer the products or services provided to you. For example, issuing a renewal or amending your policy
  • To manage a claim. For example, managing and assessing claims made under your policy or recovering monies paid to you or debts you have incurred
  • To provide you with advice as your financial adviser.
  • To comply with our legal obligations. For example, laws relating to anti money laundering
  • To enhance customer service and product options. For example, conducting customer research or customer satisfaction surveys to improve our services and products
  • To correct any errors or other actions or omissions and to deliver customer compensation and other remediation activities
  • To co-operate with regulatory-enforcement related activity (including investigation and remediation of errors, actions or omissions).
  • Purposes communicated to you at the time we collected your personal information
  • Other purposes consented to by you, or as required or permitted by law.

Using Your Personal Information

 We may use and disclose personal information we collect about you for several purposes, including after your policy ceases to be in-force or you have ceased to received services from us, that  include:

  • To consider your request for a product or service
  • To enable us to provide a product or service (including the assessment of an application for insurance, or provide you with financial advice where we are your financial adviser)
  • To tell you about other products and services that we believe may be of interest to you
  • To assist in arrangements with other organisations (such as loyalty partners and alliance partners) in relation to the promotion or provision of a product or service
  • To manage and improve products and perform other administrative, operational and remediation tasks (including risk management, processing and assessment of claims, systems development and testing, data analytics, staff training and market or customer satisfaction research)
  • To assist our reinsurers and financial advisers provide their services in relation to your product
  • To consider any concerns or complaints you raise against us and/or to manage any dispute or legal action between you and us
  • For business functions and activities conducted by or with our related entities (such as compliance reporting, information management, claims management and risk management)
  • To correct any errors or other actions or omissions and manage any customer compensation or other remediation activities
  • To co-operate with regulatory enforcement related activity (including investigation and remediation of errors actions or omissions even after your policy ceases to be in force To prevent or investigate any actual or suspected fraud, unlawful activity or other conduct; and
  • As required by relevant laws, regulations and codes of practice.

Direct marketing

If you have provided consent, we may use your personal information to communicate with you about information, offers, products or services that may be relevant and of interest to you (including through our intermediaries, distributors and/or business partners). Personal Information you have provided may be held for marketing purposes until you opt out of receiving such information. In some instances, we may disclose your personal information (but not sensitive information) to others we have business arrangements with to communicate with you for similar marketing purposes, such as to offer relevant information, products and services to you.

We do not use or disclose sensitive information for the purposes of direct marketing.

Who does Zurich share information with?

Zurich collects personal information about you to provide you with our products and services. Zurich will also, where relevant and subject to any consents required under applicable law, disclose your personal information (including in some cases sensitive information) to:

  • Other companies in the global Swiss based Zurich Insurance Group Ltd (the “Zurich Group”). The business activities of the Zurich Group are performed by various business functions which will sometimes require the exchange of information between various Zurich entities around the world.
  • An intermediary, including a professional adviser(s) or any other representative or person acting on behalf of yourself or a joint insured on your policy.
  • Other insurers or distribution partners as required to carry out activities such as providing insurance or managing a claim.
  • Reinsurers for the purposes of reinsuring policies. (For a list of relevant reinsurers and their contact details please contact the Privacy Officer, see below).
  • Service providers that assist us in carrying out our business activities, such as, investigators, claims adjusters, claims administrators, surveyors, repairers, builders, engineers, assessors, recovery agents, insurance reference bureaus, accountants, auditors, hospitals or medical professionals, rehabilitation providers, legal advisers, mediators, IT providers, suppliers, professional advisers, image and document management service provider or mailing houses.
  • An Australian Financial Service Licence holder, where we carry out business activities as your financial adviser including where we are a Corporate Authorised Representative of a Licensee.
  • Our business partners, including for example a corporate or alliance partner (such as a company that referred you to Zurich) or to whom Zurich refers you for products or services.
  • Other third parties as required to carry out activities such as assessing a claim in the event of loss or damage, including financial institutions (who for example issued the credit card under which a claim is made), another party involved in a court action or a claim (such as a third party claimant or witness), Insurance Council of Australia, dispute resolution bodies including the Australian Financial Complaints Authority (AFCA), external administrators (particularly for investment and superannuation products), an employer, the policy owner, other insureds, custodian or trustee (who is associated with a superannuation fund, investment or managed fund or a life insurance policy) and interested parties on a policy (for example a bank or premium funder).
  • Government, statutory or regulatory body and law enforcement bodies, such as tax authorities, Australian Prudential Regulation Authority, Australian Securities and Investments Commission, AUSTRAC, Office of the Australian Information Commissioner, Centrelink, Work Cover authorities, the RTA, Motor Accident Authority, Roads and Maritime Services or the police.

When do we disclose Personal Information to overseas entities?

In accordance with the purposes for which we have collected your personal information, we may disclose your personal information to a party located outside Australia. For example, we may disclose your personal information outside Australia:

  • For reinsurance purposes to reinsurers, including as part of the Zurich international commercial program
  • For Zurich Group wide activities and reporting purposes
  • For product or claims referrals to other Zurich Group companies
  • For information technology / system administration purposes
  • To provide emergency medical assistance services while you are abroad.
  • To support administration of your policy.

The countries where the person or company is likely to be located include Austria, Belgium, Canada, Denmark, Finland, France, Germany, Guernsey, India, Italy, Hong Kong, Japan, Malaysia, New Zealand, Norway, Philippines, Romania, Singapore, Spain, Sweden, Switzerland, Taiwan, United Kingdom, Poland, South Africa and United States of America. Also as part of a global insurance group, in some cases we may disclose your personal information to another Zurich Group entity outside Australia. We may also use other offshore service providers to help provide you with our products and services or identify ways to improve our service to you.

If you have an interaction with one of our Customer Service Teams, we may send you an automated follow up request for your feedback on your experience(s). We use external service providers based overseas to help us send you the automated request and to analyse responses. We will therefore need to send your information to these locations.

The above is not a complete list of the countries to which your information may be disclosed when using our products or services. In some circumstances, the nature of the product or service you request may require us to disclose your information overseas and the countries to which we may disclose your information will depend on the particular circumstances.

How do we store and secure your personal information?

At Zurich we take the security of personal information very seriously and we invest heavily in security protective measures to safeguard our clients and their data across our systems. Any personal information collected and stored within Zurich is secured using industry standard technology and processes.

Our staff are regularly trained on Information Security protocols and we work with our service providers to ensure your personal information is kept safe and secure.

How does Zurich use cookies & digital tools?

A cookie is a small, text-based file used frequently on some websites and portals. They can be permanently stored on your hard drive (persistent cookie) or in your computer's memory (session cookie).

Zurich uses session cookies to interact with your browser. They are designed to assist and streamline the exchange of information between your computer's browser and our computer systems. For example, a session cookie is created after you log in with your user name and password and your access is authenticated. The session cookies assist in validating that Zurich's computer is communicating with your web browser throughout the time you access the website during the session. When you end the session by logging off or closing the browser, the session cookie is rendered inoperable.

Other cookies used by Zurich collect information about the use of Zurich's website. The information collected includes where visitors connect from, what version of browser they use and their path through the site. In some circumstances, cookies can also provide information to identify a person. It helps us to provide personalised features, to meet online expectations of many of our clients, to improve our services and products, as well as to keep our content fresh and relevant.

When you apply for an insurance policy or seek financial advice using our website or our online forms, Zurich collects personal information about you as a part of your application or request for advice. Once you submit your application or request online, Zurich may use cookies, which in this case may personally identify you through your information, to identify traffic source, to improve our website and our customers’ experience, as well as to keep our content fresh and relevant.

Zurich may also use third party remarketing cookies e.g. through Google AdWords, LinkedIn Insight Tag and Facebook Ads. These cookies allow us to display tailored advertising to you on different websites across the internet and on social media platforms based on your prior visits to our site. Zurich and some of these third parties may also use the information to optimise ad selection for groups of individuals based on age, gender, interests and past visits to sites. Importantly, we do not collect any identifiable information about you through this remarketing process nor combine the anonymous information with personally identifiable information. The use of cookies however, is ultimately governed by you, as you can choose if and how a cookie can operate by configuring certain preferences and options in your browser. These need to be enabled if you wish to use the secure log in services. Choosing to disable cookies may mean you are not able to access all features of a site including the secure log in services.

We utilise web analytics reporting software to report and measure traffic patterns to, from and within this website. The tracking technology collects various information, such as the visitor’s domain name and IP address, which pages are visited, the number of unique visitors, paths taken within the website, duration of visits and entry / exit points to the website. A User ID may be assigned to an individual user to track engagement from one or more sessions initiated from one or more devices.

We use the aggregated reporting provided by web analytics to better manage, analyse and develop our websites, as well as to improve customer experience and improve our services and products.

When you apply for an insurance policy or seek financial advice using our website or our online forms, Zurich collects personal information about you as a part of your application or request for advice. Zurich may use web analytics reporting software with this data to help us improve the services we provide. All personal information collected and held will be in accordance with this Privacy Policy.

How does Zurich handle a request for access or correction to personal information?

You have the right to request access to personal information that we hold about you, and if applicable, to request correction.

Where you are entitled to access personal information, the time we require to give you access will depend on the type of information requested. If we can, we will answer your question immediately. We will also try to answer you in the same way that you ask - for example, if you telephone to ask for the information we will, if practicable, give you that information over the telephone. We will generally respond to a written request in writing.

Sometimes, we will ask that you put your request in writing, for example, where it is necessary for us to retain a record of your request.

We may also ask you to identify yourself to our satisfaction at the time of requesting the information.

You may be able to access some information yourself through Zurich's website. If you have difficulties finding the information you want or using the website, please advise us.

In some circumstances, we may charge a fee for giving you access, which will vary but will be based on our costs (internal and external) in locating the information and the form of access you require. If we propose to charge a fee for giving access, we will give you an estimate of the fee so you can confirm that you still want us to give you access to the information. We do not impose any charge for lodging a request for access.

Please tell us if some of the personal information Zurich holds is wrong as we want our records to be accurate, complete, up to date and relevant. Unless we disagree with you about the accuracy or completeness of a record, we will generally correct it on request, (or suggest alternative arrangements for updating our records).

Managing your complaint

Zurich will confirm that we have received your complaint within 1 business day (or as soon as practicable) and work with you to provide an outcome as quickly as possible. Your contact will keep you regularly updated with the progress and will work with you to discuss options to resolve your complaint.

Once we have come to a decision on the outcome of your complaint, we will discuss the proposed outcome with you.

We will write to you, where required, and our response will outline the outcome of your complaint. In most instances, our complaints decision will be provided no later than 30 calendar days, or 45 calendar days if it relates to a superannuation product. Where we cannot resolve your complaint within this timeframe, we will advise you in writing.

If your complaint is not satisfactorily resolved, you may access an external dispute resolution scheme such as the Australian Financial Complaints Authority (AFCA) or apply to the Office of the Australian Information Commissioner (OAIC) to have the complaint heard and determined. When we write to you about our decision, we will explain how you may access an appropriate external dispute resolution scheme or lodge a complaint with the OAIC.
